These Terms of Service govern your use of the MacrosGPT mobile application and related services.

By downloading, accessing, or using MacrosGPT, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using MacrosGPT, you confirm that you:

• Are at least 13 years old
• Understand this is not medical advice
• Agree your data may be used to train AI models
• Agree to binding arbitration for disputes
• Agree to subscription terms and payment policies
• Understand the app may change over time

2. Description of Service

MacrosGPT is an AI-powered calorie and nutrition tracking app including:

• Calorie and macro logging
• Food photo logging
• Weight and progress tracking
• AI-generated insights and coaching
• Optional paid subscription features

The app is not a medical device and is not intended to diagnose, treat, or prevent any health condition.

3. Health & Safety Disclaimer

A. MacrosGPT does NOT provide medical advice.

The Service:

• Does not provide medical, dietary, or fitness advice
• May generate inaccurate or incomplete nutritional suggestions
• Should not be relied on for health decisions
• Cannot diagnose or predict medical conditions

B. Always consult a licensed professional.

Before making dietary, nutrition, exercise, or lifestyle changes, speak with a physician, registered dietitian, or licensed medical professional.

C. You agree to ignore any statements that appear medical.

If the AI outputs anything resembling a diagnosis, medical warning, prescription-like advice, or treatment recommendations, you agree to disregard it entirely.

D. You agree that you use the app at your own risk.

"MacrosGPT and its developer assume no liability for any decision made or action taken based on AI or app content."

4. User Accounts

To use MacrosGPT, you must create an account using Apple Sign-In, Google Sign-In, or email and password. You are responsible for:

• Maintaining account security
• Keeping login credentials confidential
• All activity under your account

The developer may suspend or terminate accounts that violate these Terms.

5. Subscription, Payments, and Free Trial

A. Subscription Required for AI Features

The core AI chat and advanced coaching features require a paid subscription.

B. Free Trial

MacrosGPT offers a 7-day free trial. After the trial ends, your subscription will automatically renew unless cancelled.

C. Payment Handling

All payments are processed by Apple App Store Billing and Google Play Billing. You agree to their payment terms. Refunds must be requested directly from Apple or Google.

D. Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.

E. Pricing Changes

The developer may update pricing with notification before changes take effect.

6. Acceptable Use

You agree not to:

• Use the Service for illegal purposes
• Exploit the AI for harmful or abusive content
• Attempt to reverse-engineer or tamper with the Service
• Upload harmful code or viruses
• Misrepresent yourself
• Use the Service to track calories for another person without consent

The developer may restrict access if misuse is detected.

7. AI Usage Terms

A. AI Provider Independence

"MacrosGPT is an independent product" and is not affiliated with, endorsed by, or associated with OpenAI, ChatGPT, or other AI companies. The term "GPT" refers to the app's use of generative AI technology for nutrition coaching and does not imply partnership with OpenAI. AI features are powered by third-party models selected at the developer's discretion.

B. AI Outputs Are Not Guaranteed to Be Accurate

The Service may produce:

• Incorrect calorie estimates
• Incorrect nutrition analysis
• Inaccurate suggestions
• Hallucinated information

You agree to independently verify all information.

C. You Agree That Data May Be Used for AI Training

By using MacrosGPT, you consent to your logs, photos, chat messages, and profile data being used to improve AI systems.

D. No Expectation of Perfection or Reliability

You acknowledge the Service may have downtime, produce incorrect answers, lose data, or fail to detect certain foods or calories, and you accept these risks.

8. Intellectual Property

All content, features, and functionality are owned by the developer. You may not copy, modify, distribute, resell, or create derivative works without permission.

9. Account Termination

The developer may terminate or suspend access if you:

• Violate these Terms
• Misuse the app
• Abuse the AI system
• Engage in fraudulent activity

The Service may also be discontinued at the developer's discretion. You may delete your account at any time.

10. Disclaimer of Warranties

"MacrosGPT is provided 'as is' without warranties of any kind." The developer does not guarantee accuracy, error-free operation, reliability, security, or fitness for any particular purpose. You assume full responsibility.

11. Limitation of Liability

To the fullest extent permitted by law, the developer is not liable for:

• Harm from relying on AI outputs
• Personal injury from dietary or fitness choices
• Loss of data
• Subscription charges
• Inaccurate nutritional information
• Service outages
• Indirect damages

Your sole remedy is to stop using the Service.

12. Binding Arbitration Agreement

A. You Agree to Resolve All Disputes Through Arbitration

Any dispute, claim, or controversy must be resolved through binding arbitration administered by a third-party arbitrator.

B. No Class Actions

You agree not to participate in class action lawsuits, class-wide arbitration, or representative claims.

C. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. If any part of this arbitration agreement is found invalid, the remaining portions remain in effect.

13. Changes to the Service

The developer may modify or discontinue any part of the Service at any time and may update these Terms. Material changes will be communicated via email or in-app notice.
